2025 Chapter 2An Act to make provision about the status of, and privileges and immunities in connection with, the Commonwealth Parliamentary Association and the International Committee of the Red Cross; and for connected purposes.

Be it enacted by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

I33 Evidence¶
If in any proceedings a question arises whether a person is or is not entitled to any privilege or immunity by virtue of an Order in Council made under section 1 or 2, a certificate issued by or under the authority of the Secretary of State stating any fact relating to that question is conclusive evidence of that fact.I44 Orders in Council¶
I55 Interpretation¶
In this Act—-
“the ICRC” has the meaning given by section 2(1)(a);

“statutory provision” means provision made by or under any of the following, whenever passed or made—
-
an Act;
-
an Act or Measure of Senedd Cymru;
-
an Act of the Scottish Parliament;
-
Northern Ireland legislation;
-
assimilated direct legislation.

Such inviolability of official archives and premises of the qualifying organisation as in accordance with the 1961 Convention Articles is accorded in respect of the official archives and premises of a diplomatic mission.I93 Taxes and duties¶
Exemption or relief (by way of refund or otherwise) from any tax or duty.I104 Rates¶
Such relief from rates as in accordance with Article 23 of the 1961 Convention Articles is accorded in respect of the premises of a diplomatic mission.I115 Import and export restrictions¶

Immunity from suit and legal process in respect of things done or omitted to be done in the course of the performance of official duties.I137 Income tax¶
Exemption from income tax in respect of emoluments received as the qualifying person.I148 Import of articles for personal use¶
I159 Inspection of personal baggage¶
Such exemption and privileges in respect of the personal baggage of the qualifying person as in accordance with paragraph 2 of Article 36 of the 1961 Convention Articles are accorded to a diplomatic agent, as if in that paragraph the reference to paragraph 1 of that Article were a reference to paragraph 8 of this Schedule.I1610 Social security¶
Exemptions whereby, for the purposes of the statutory provisions relating to social security—Part 3 Interpretation¶

“qualifying organisation” means—
-
an organisation specified under section 1(1), or
-
the ICRC;
-
-
“qualifying person” means a person on whom privileges and immunities may be conferred under section 1(1)(c) or 2(1)(c) of this Act;
-
“the 1961 Convention Articles” means the Articles (being certain Articles of the Vienna Convention on Diplomatic Relations signed in 1961) which are set out in Schedule 1 to the Diplomatic Privileges Act 1964.
