When a mortgagee of land has been in possession of any of the mortgaged land for a period of twelve years, no action to redeem the land of which the mortgagee has been so in possession shall be brought after the end of that period by the mortgagor or any person claiming through him.C1317 Extinction of title to land after expiration of time limit.¶

- “the court” means the court in which the action has been brought;
- “Her Majesty's forces” has the same meaning as in the Armed Forces Act 2006 (see section 374 of that Act);
- “overseas operations” means any operations outside the British Islands, including peacekeeping operations and operations for dealing with terrorism, civil unrest or serious public disorder, in the course of which members of Her Majesty's forces come under attack or face the threat of attack or violent resistance;
- “the section 11 relevant date” means the latest of the following—
- the date from which the period of three years starts to run in accordance with section 11(4) or (5);
- where section 28 applies, the date from which the period of three years mentioned in subsection (1) of that section (as that subsection has effect with the modification made by subsection (6) of that section) starts to run;
- where section 32(1)(a) or (b) applies, the date from which the period of three years starts to run in accordance with subsection (1) of that section;
- “the section 12 relevant date” means the latest of the following—
- the date from which the period of three years starts to run in accordance with section 12(2);
- where section 28 applies, the date from which the period of three years mentioned in subsection (1) of that section (as that subsection has effect with the modification made by subsection (6) of that section) starts to run.

- “ADR” has the same meaning as in Chapter 4 of Part 4 of the Digital Markets, Competition and Consumers Act 2024;
- “ADR entity” means a person who carries out ADR in compliance with section 293(1) of that Act (which prohibits persons from carrying out ADR unless exempt, accredited, or acting under special ADR arrangements, in accordance with Chapter 4 of Part 4 of that Act);
- “consumer contract dispute” has the same meaning as in Chapter 4 of Part 4 of that Act.

- “action” includes any proceeding in a court of law, including an ecclesiastical court (and see subsection (11) below);
- “land” includes corporeal hereditaments, tithes and rent-charges and any legal or equitable estate or interest therein F37... but except as provided above in this definition does not include any incorporeal hereditament;
- “personal estate” and “personal property” do not include chattels real;
- “personal injuries” includes any disease and any impairment of a person’s physical or mental condition, and “injury” and cognate expressions shall be construed accordingly;
- “rent” includes a rentcharge and a rentservice;
- “rentcharge” means any annuity or periodical sum of money charged upon or payable out of land, except a rent service or interest on a mortgage on land;
- “settled land”, “statutory owner” and “tenant for life” have the same meanings respectively as in the M20Settled Land Act 1925;
- “trust” and “trustee” have the same meanings respectively as in the M21Trustee Act 1925; and

39 Saving for other limitation enactments.¶
This Act shall not apply to any action or arbitration for which a period of limitation is prescribed by or under any other enactment (whether passed before or after the passing of this Act) or to any action or arbitration to which the Crown is a party and for which, if it were between subjects, a period of limitation would be prescribed by or under any such other enactment.40 Transitional provisions, amendments and repeals.¶
