After Clause 1, insert the following new Clause—
“Regulations

Clause 1, page 1, line 5, leave out “on a sliding scale”

Clause 1, page 1, line 7, after “amount” insert “in real terms”

Clause 1, page 1, line 11, at end insert—
“(1C) A decision by a person to whom child benefit is payable in accordance with paragraph (1A) shall be disregarded for the purposes of applying the benefit cap under section 96 of the Welfare Reform Act 2012, with that calculation to be made as if child benefit were being paid at the rate specified in paragraph (1).”

Clause 2, page 1, line 16, at end insert—
“(1A) The Secretary of State must by regulations specify a process to allow a person to whom child benefit is payable to receive advice from an independent person prior to making a determination to be paid in accordance with section 1.”

After subsection (1) insert—
“(1A) Regulations under subsection (1) may specify arrangements to apply in the case of changes to a person’s eligibility for child benefit during the qualifying young person’s childhood, including (but not limited to) changes to a child’s care arrangements.”

After subsection (1) insert—
“(1A) Regulations under subsection (1) may not impose additional conditions on people who choose to be paid child benefit in accordance with the mechanism in section 1.”
